EPOの料金改定および新たな減額制度の導入
欧州特許庁（EPO）は2024年1月31日に料金の改定を発表しておりましたが、この新たな料金体系は2024年4月1日に発効しました。今回の料金改定では主要項目については料金の値上げとなりましたが、一方で、極小規模の企業（microenterprise）等に対する減額制度が新たに導入されました。この新たな減額制度はEPO加盟国以外の国の出願人にも適用され、日本の出願人も利用可能です。これらの新料金体系は、2024年4月1日以降のEPOに対する庁手続から適用されます。
１．主要な改定料金

２．新たな減額制度の導入
（１）制度の概要
EPOはこれまでもEPO加盟国の出願人に対する減額制度を設けておりましたが、この度、加盟国の出願人であるか否かに関わらず、極小規模の企業、自然人、非営利団体、大学、および公的研究機関が確実に欧州での特許保護を取得し、そして欧州全土での発明品の商品化を行えるようにするため、新たな減額制度を導入しました。
（２）減額制度の対象
国籍・居住地に関わらず、極小規模の企業、自然人、非営利団体、大学、および公的研究機関が対象となります。したがって、日本の出願人も減額を受けることができます。
極小規模の企業（microenterprise）の定義は、2003年5月20日付けの欧州連合官報（Official Journal of the European Union）のL 124（OJL 124 20.05.2003, p.1）に記載されています（下記の情報元④を参照ください）。この欧州連合官報の定義によりますと、極小規模の企業は、従業員の人数が10人未満であり、年間売上高および／または年間貸借対照表合計が200万ユーロを超えない企業として定義されています（a microenterprise is defined as an enterprise which employs fewer than 10 persons and whose annual turnover and/or annual balance sheet total does not exceed EUR 2 million.）。
さらに減額の適用を受けるために出願人は、過去5年間に提出した欧州特許出願（PCTの欧州移行を含む）が5件未満であることが必要です。なお、減額の申請は欧州特許出願の願書において行うことができます。
（３）減額の内容
欧州特許の付与手続きにおけるすべての主要手数料（出願、調査、審査、国指定、登録、維持年金）について30%の減額を受けることができます。
（４）注意点
EPC施行規則に新たに追加された7条bの(4)項は以下のように規定しています（情報元②を参照）。
“(4) Should it become apparent that an incorrect declaration has been filed or the European Patent Office has not been informed of a change of status in accordance with paragraph 2 and a reduced payment is made, the fee shall be deemed not to have been paid and the application shall be deemed to be withdrawn.”
したがいまして、企業のステータスの誤った申告や、企業のステータスが変更された場合の更新忘れは、適正な料金が支払われていなかったものとされ、特許出願が取り下げられたとみなされる深刻な結果を招く可能性があることに注意しなければなりません。
